1. About Bookmoth

Bookmoth provides learning intelligence tools for African secondary schools, including curriculum-aligned assessments, computer-based testing (CBT), topic mastery tracking, exam readiness insights, reporting, and school administration features.

Bookmoth is offered as a subscription software service. Features available to your school depend on the plan you select and any entitlements configured for that plan (such as seat limits, exam-body access, and assessment allowances).

2. Eligibility and school accounts

The Service is intended for use by secondary schools, authorised administrators, teachers, students, and parents or guardians linked to a school account.

The person who registers a school represents that they have authority to bind that school to these Terms, to designate administrators, and to manage student and staff accounts in accordance with applicable education and data-protection laws.

You must provide accurate registration information and keep billing, contact, and administrator details up to date.

3. Accounts, access, and security

Each user must use credentials issued for their role. Schools are responsible for managing invitations, role assignments, password practices, and timely deactivation of accounts when staff or students leave.

You must not share administrator credentials, attempt to bypass security controls, or access data belonging to another school without authorisation.

Bookmoth may suspend access where we reasonably believe there is misuse, security risk, non-payment, or a material breach of these Terms.

4. Acceptable use

You agree to use the Service only for lawful educational and administrative purposes. You must not upload unlawful, harmful, or infringing content; interfere with platform integrity; scrape or reverse engineer the Service except as permitted by law; or use Bookmoth to harass learners or staff.

Assessment content, curriculum materials, and AI-generated items must be reviewed by qualified educators before high-stakes use. Bookmoth does not replace professional teaching judgement or official examination board requirements.

5. Subscriptions, billing, and plans

Paid plans are billed according to the pricing, billing interval, and payment method selected at checkout or agreed with Bookmoth. Fees may be displayed in local currency and settled according to Bookmoth’s payment configuration.

Plan limits (including students, teachers, exam bodies, subjects, and assessments per student) apply to your school while that plan is active. Exceeding limits may require an upgrade or may block additional actions until capacity is available.

Unless otherwise stated, subscriptions renew automatically until cancelled. Cancellation ends future renewals; access continues until the end of the paid period unless terminated earlier for breach.

6. School content and intellectual property

Schools retain ownership of content they upload or create (such as school curricula, questions, and reports), subject to the licences needed for Bookmoth to host, process, display, and back up that content to provide the Service.

Bookmoth and its licensors retain all rights in the platform, branding, software, default curriculum libraries, and aggregated non-identifying insights used to improve the Service.

You must not remove proprietary notices or use Bookmoth marks without prior written permission.

7. AI features and educational outcomes

Where AI features are enabled (for example quiz generation or insights), outputs may be incomplete or inaccurate and require human review before classroom or examination use.

Bookmoth does not guarantee specific academic results, examination board outcomes, or regulatory approvals. Readiness scores and alerts are decision-support tools, not official certifications.

8. Privacy and student data

Processing of personal data is described in our Data Protection and Privacy Policy. By using the Service, the school confirms it has a lawful basis to provide learner and staff data to Bookmoth for educational administration and service delivery.

Schools remain responsible for obtaining any required parental or guardian consents under local law for student accounts and communications.

9. Service availability and changes

We aim to keep Bookmoth reliable and available, but the Service may be interrupted for maintenance, upgrades, network issues, or events beyond our reasonable control.

We may update features, interfaces, and these Terms to improve security, compliance, or product quality. Material changes will be communicated through the Service or by email where practicable. Continued use after the effective date constitutes acceptance of updated Terms.

10. Limitation of liability

To the fullest extent permitted by applicable law, Bookmoth is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or examination outcomes arising from use of the Service.

Our aggregate liability arising out of these Terms or the Service is limited to the fees paid by your school to Bookmoth for the Service in the twelve (12) months preceding the claim, except where liability cannot be limited by law.

11. Termination

Either party may terminate for material breach if the breach is not cured within a reasonable period after notice. Bookmoth may terminate or suspend immediately for serious misuse, fraud, or legal risk.

Upon termination, your right to access the Service ends. We may retain data as required by law or as described in the Privacy Policy, and may provide export options where available before account closure.

12. Governing law and contact

These Terms are governed by the laws applicable to Bookmoth’s primary place of business, without prejudice to mandatory consumer or education protections that apply in your country.
